1. Acceptance of terms

By accessing or using this website (the “Site”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, please do not use the Site.

These Terms apply to all visitors and users. They do not replace a signed proposal, statement of work, master services agreement, or other written contract between you and Senirop SAS. In the event of conflict, the written contract governs the commercial relationship.

2. About Senirop and the Site

Senirop SAS (“Senirop”, “we”, “us”) is a technology consulting and software engineering firm headquartered in Ecuador. We partner with organizations on AI strategy, product delivery, and platform engineering.

The Site is a marketing and informational channel. It describes our capabilities, team, and selected client outcomes. It is not an e-commerce platform and does not itself provide contracted consulting deliverables.

3. Eligibility and acceptable use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not:

• Attempt to gain unauthorized access to our systems, networks, or data, or interfere with the Site’s operation or security.
• Use automated means (bots, scrapers, or similar tools) to extract content or overwhelm our infrastructure without prior written consent.
• Upload or transmit malware, spam, or content that is unlawful, defamatory, harassing, or infringing on third-party rights.
• Misrepresent your identity or affiliation when contacting us or using Site features.
• Use the AI assistant or contact form to submit credentials, payment card data, health information, or other sensitive personal data not requested by us.

We may suspend or restrict access to the Site, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

4. No client or employment relationship

Browsing the Site, submitting a contact form, or interacting with the AI assistant does not create a consulting, agency, partnership, joint venture, or employment relationship between you and Senirop.

Any engagement for professional services requires mutual agreement on scope, fees, timelines, and other terms documented in writing. Proposals and estimates shared through the Site or email are non-binding until formally accepted by both parties.

5. Intellectual property

The Site and its content—including text, graphics, logos, icons, photographs, layouts, software, and design elements—are owned by Senirop or its licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your personal or internal business evaluation. You may not copy, modify, distribute, publicly display, reverse engineer, or create derivative works from Site content except as permitted by applicable law or with our prior written consent.

Client names, logos, and case study materials displayed on the Site remain the property of their respective owners and are used with permission or as otherwise permitted.

6. Information on the Site

Content on the Site is provided for general information about Senirop’s consulting practice. While we strive for accuracy, we do not warrant that all information is complete, current, or error-free.

Nothing on the Site constitutes legal, financial, tax, or other professional advice. Decisions based on Site content are your responsibility. Specific recommendations belong in a formal engagement tailored to your context.

Metrics, outcomes, and testimonials reflect past or representative client experiences. Results vary by organization, scope, and execution. They are not guarantees of future performance.

7. Third-party links and services

The Site may contain links to third-party websites, platforms, or services (for example, LinkedIn, client websites, or map providers). Those destinations are governed by their own terms and privacy practices. We are not responsible for third-party content, availability, or policies.

Embedded tools—such as analytics tags, email delivery, AI model providers, or map iframes—may process technical or personal data according to their respective provider terms. See our Privacy policy for how we use such services.

8. AI assistant

When enabled, the Site may offer an AI-powered assistant to answer general questions about Senirop’s services. The assistant:

• Provides informational responses only and does not constitute a binding offer, quote, or professional recommendation.
• May produce incomplete or inaccurate information; verify important details through direct contact with our team.
• Is subject to usage limits and may be unavailable without notice, including when required API keys or infrastructure are not configured.
• Must not be used to transmit confidential business information, credentials, or personal data you are not authorized to share.

Conversations may be processed by third-party AI providers under the conditions described in our Privacy policy.

9. Contact form and submissions

When you submit information through our contact form or email, you represent that the information is accurate to the best of your knowledge and that you have the authority to provide it.

You grant Senirop a non-exclusive license to use submissions solely to evaluate and respond to your inquiry and, where applicable, to pursue a potential business relationship. We handle personal data as described in our Privacy policy.

10. Site availability

We aim to keep the Site available and secure, but we do not guarantee uninterrupted, timely, or error-free operation. Maintenance, updates, hosting events, or factors outside our control may cause temporary unavailability.

We may modify, suspend, or discontinue any part of the Site at any time without liability to you.

11. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Site and all content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

12. Limitation of liability

To the maximum extent permitted by Ecuadorian law, Senirop and its directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities arising from or related to your use of the Site.

Our aggregate liability for claims related to the Site shall not exceed one hundred United States dollars (USD 100), except where liability cannot be limited under mandatory applicable law.

13. Indemnification

You agree to indemnify and hold harmless Senirop from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site, your violation of these Terms, or your infringement of third-party rights, except to the extent caused by our gross negligence or willful misconduct.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Ecuador, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or use of the Site shall be submitted to the competent courts of Quito, Pichincha, Ecuador, unless mandatory consumer or procedural rules require otherwise.

Data protection matters are additionally subject to the LOPDP and regulations issued by Ecuador’s Personal Data Protection Authority.

15. Changes to these Terms

We may revise these Terms at any time by posting an updated version on this page. The “Last updated” date indicates when changes were last made. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

If you do not agree to updated Terms, you must stop using the Site.
